Divorce Mediation
Mediation is a voluntary process in which the parties make decisions together based on their understanding of their own views, each other’s and the reality they face.  As the neutral, we provide mediation services to assist couples in the negotiation of their financial issues.  We utilize attorney mediators to handle all of the legal issues and draft the final agreement. 
 
Collaborative Divorce
Collaborative Divorce is an alternative to both mediation and the adversarial process.  Collaborative Divorce is based on 3 principles:
  • A pledge not to go to court
  • A honest exchange of information by both spouses
  • A solution that takes into account the highest priorities of both spouses and their children
The collaborative process benefits those individuals who feel they need individual representation, but want to avoid the stress and expense of a trial.  

Your Collaborative Divorce Team may consist of:

  • Two Collaborative Divorce Attorneys who are independently retained and have specialized training in Collaborative Law as well as Divorce Mediation.  Attorneys and clients agree in advance not to go to court
  • One jointly retained neutral Financial Specialist who has specialized training in Collaborative Divorce Team Practice as well as training in Divorce Mediation.  Walter Wisniewski, CFP® and Rita Medaglio-Barrera, CDFA™, CSA® are members of the New York Association of Collaborative Professionals (NYACP) and the International Academy of Collaborative Professionals (IACP).
  • One or two Collaborative Coaches who are licensed as a Certified Mental Health Professional with expertise in the psychological dynamics of divorce and specialized training in Collaborative Team Practice as well as training in Divorce Mediation.
 
Divorce Financial Planning and Analysis
A Certified Divorce Financial Analyst ™ helps provide a clear & complete financial picture so that an accurate, fair and equitable settlement can be achieved more quickly.  As financial professionals, we are specially trained and experienced in the financial issues of divorce and can be called upon as an expert witness, if necessary.   

Prior to a settlement, regardless of the divorce process you utilize, we can provide the following:

  • Prepare Cash Flow Analysis, Lifestyle Analysis, in Preparation of the Net Worth  Statement
  • Assist in drawing up budgets that demonstrate the appropriate level of spousal and/or child support
  • Perform Maintenance and Child Support Analysis
  • Evaluate the stocks, bonds and mutual funds that are to be divided
  • Determine the tax liability and liquidity of property to ensure equitable division of assets
  • Help with determining the short-term and long-term financial impact of a divorce settlement by providing valuable insight into the pro’s and con’s of different settlement proposals
  • Determine how much money you’ll need to live on and project retirement and insurance needs
  • Estimate College and Educational Costs
  • Estimate Career Training Costs and Time Horizons
 

DIVORCE SETTLEMENT ANALYSIS

Perhaps our most important role in the divorce process is in projecting the long-term viability of a proposed after-tax settlement option. We prepare spreadsheets and charts which can provide you with a sense of how you will survive financially.

Many questions arise when dividing up property, such as, Should I keep the house or take the pension? Will I have enough money to retire? What lifestyle will I be able to afford?

Through personalized charts and graphs both spouses can have a clearer view of their financial future and can approach a settlement that fully addresses their financial needs.
